TASS: Vladimir Putin signed the law on transfer of rights to inventions created with budget funding to the authors

 

On December 22, 2020, The President of the Russian Federation Vladimir Putin signed a law aimed at creating a legal framework for the commercialization of the Results of Intellectual Activity (RIA) created with funding from the state budget. The Law establishes the priority assignment of the exclusive rights to the invention to the executor of the state R&D contract.

At the same time, in order to facilitate the practical implementation of inventions, the Law obliges the contractor to implement the RIA in practice within two years from the date of the emergence of the exclusive right or to transfer this right to other interested parties. The law determines which objects of intellectual property are considered RIA in the field of defense and security, and also stipulates that the rights to them belong to the Russian Federation, but may also belong to the executor of the state contract in the cases and in the manner determined by the President of Russian Federation. The law will enter into force on 01.01.2022.
