The Opposition Procedure Will Reduce the Period for Consideration of the Application by Rospatent

Rospatent plans to reduce the time it takes to consider applications and grant patents for industrial designs by switching to the opposition procedure, as it will increase the reliability of the patent while reducing the labor costs of experts, as well as ensure closer registration procedures for Eurasian, international and Russian industrial designs. Public opposition is a mechanism tested by a number of patent offices around the world to protect earlier rights to intellectual property and prevent the registration of borrowed design solutions at the phase of application consideration. At the same time, any person who makes reasonable arguments against the registration of industrial designs will be able to influence the decision directly. To introduce this procedure, Rospatent plans to develop affordable means for tracking received applications and form the skill of market participants to raise reasonable oppositions if they consider wrong to grant a patent for one or another design.
