AIF: New procedure introduced to outsource examination for inventions and utility models
On January 8, 2021 a new procedure of conducting preliminary information search and patentability assessment for inventions and utility models was introduced in Russia. The procedure will be carried out on demand of the applicant by Russian scientific and educational establishments accredited by Rospatent.
Introduction of the procedure pursues 3 main goals. Firstly, it seeks to reduce the volume of Rospatent examiners’ preparatory work and to understand the substance of the claimed invention more quickly. Secondly, it aims to improve the patent quality by tasking industry experts to examine the prior art and assess the patentability of a technical solution before substantive examination by Rospatent’s examiners. Thirdly, applicants who submit the results of preliminary procedures to Rospatent will receive a discount on the fee for substantive examination.
