Ratification of EAEU Treaty on Trademarks, Service Marks and Appellations of Origin

 

On 27 October 2020, the State Duma of the Russian Federal Assembly discussed and adopted the Draft Federal Law On Ratification of the Treaty on Trademarks, Service Marks and Appellations of Origin of the Eurasian Economic Union (EAEU).

Speaking as an official representative of the Russian Government at the Duma's plenary meeting, Head of Rospatent Mr. Grigory Ivliev, noted that the Treaty implementation would be an important step towards Eurasian integration in the field of intellectual property and that it will reduce the time and financial costs of obtaining the IP rights protection and increase legal certainty for the rights holders from EAEU countries taking into account the Customs Union and the Single Economic Area.

The Treaty will enter into force after the depositary receives the last written notification on the completion of all the required internal procedures in the EAEU countries.

 

Background information:

The EAEU Treaty on Trademarks, Service Marks and Appellations of Origin of Goods was signed on 3 February 2020. An application for trademark or appellation of origin of the Union can be filed with any of the five national patent offices in Armenia, Belarus, Kazakhstan, Kyrgyzstan, and Russia. At the same time, the registration fees are lower than those payable under national procedures.

The receiving office processes the regional application, carries out a formal examination, and submits the application to other offices for substantial examination. If the protection cannot be granted in all the EAEU states, the regional application can be converted into a national one.
