EAPC Industrial Designs Protocol Ratified


On 23 November 2020, President of the Russian Federation Vladimir Putin signed the Federal Law on Ratification of the Protocol concerning the Protection of Industrial Designs to the Eurasian Patent Convention (EAPC) dated 9 September 1994. The Law will enter into force ten days after the official publication.

The Protocol will establish the Eurasian system for the protection of industrial designs. By analogy with the Eurasian patent system, an applicant will be able to obtain legal protection for an industrial design simultaneously in eight Contracting States based on a single application submitted to the Eurasian Patent Office (EAPO) instead of filing applications in each State.

The Protocol has already been ratified by Armenia, Azerbaijan, and Kyrgyzstan. The Kyrgyz side has deposited its instruments of ratification with the depositary, Director-General of World Intellectual Property Organization (WIPO) Daren Tang. The Protocol will enter into force three months after the three countries have deposited their instruments of ratification with WIPO.


Background information:

The industrial design application may be filed directly with EAPO or the national patent office of a Contracting State to the Protocol (Armenia, Azerbaijan, Kazakhstan, Kyrgyzstan, Russia, and Tajikistan) that transfers it to EAPO.
