Innovations of the Russian Office for Intellectual Property: Unified electronic registers of rights, waiver of duties for the grant of patents and the transition to “digital format”


The central place in the online discussion "Peculiarities of patent protection in the context of a pandemic and after pandemic", organized on September 23, 2020 by the “Egorov, Puginsky, Afanasiev & Partners” Law Office was taken by the report of Dmitry Travnikov, Head of the Department for Organization and Provision of Public Services of Rospatent. He reported on the steps that the Office and the legislature took to meet the applicants during the pandemic.

The Government and the State Duma adopted a number of initiatives to alleviate the position of applicants, in particular the deadlines for payment of patent and other fees were extended; the range of actions within the framework of electronic interaction between Rospatent and applicants was expanded. The Federal Law “On Amendments to Part Four of the Civil Code of the Russian Federation” was signed, which implies the possibility of providing, together with the application, three-dimensional models of the claimed objects of intellectual property, as well as the issuance of electronic titles of protection.

After the entry into force of the Law, this will allow completely switch to electronic interaction within the framework of the provision of state services of Rospatent. Another initiative is the creation of a system for preliminary information search and patentability assessment. Travnikov also outlined the problems of protecting patent rights in the circulation of medicines and stressed the importance of creating a new mechanism for their protection. In this regard, the initiative of Rospatent to create a unified Eurasian register of pharmacologically active effective substances protected by patents for inventions is very important.
