Vladimir Putin signed the law on regional brands



Vladimir Putin, the President of the Russian Federation, signed the law, aimed at promoting regional brands, that implements a new independent object of the intellectual rights – a “geographical indication”- into the Civil Code of the Russian Federation. According to the law, a geographical indication, which is a designation identifying a product, which features are, to a large extent, associated with its origin, can be used in regard to the product provided that at least one of the phases of production, that significantly affects the characteristics of the product, takes place on the territory of the given geographical object. The law provides for a whole range of situations when a geographical indication can not be registered, for example, if it duplicates an already existing trademark or if it misleads a consumer.

The geographical indication is admitted and protected based on the state registration which will be provided by Rospatent. The brand can be registered by an individual, a legal entity, an association and a union. The exclusive right to a geographical indication is granted for 10 years starting from the date of filing an application to Rospatent. Upon application of the rightholder, the given term can be extended - each time for 10 years.
